Carrier Liability & Limitations Policy
This Carrier Liability and Limitations Policy outlines the extent of liability assumed by 16847323 CANADA LIMITED operating as Eyemesto Shipping ("Eyemesto Shipping") and its carrier partners in connection with shipments made through the platform. By using the platform, you acknowledge and agree to the terms set out herein.
1. Overview
This policy describes how liability is allocated between Eyemesto Shipping, its carrier partners, and platform users for loss, damage, theft, delay, or failure of any shipment arranged through the Eyemesto Shipping platform.
2. Role of Eyemesto Shipping
Eyemesto Shipping acts solely as a technology intermediary and logistics broker, connecting users with third-party carrier services. Eyemesto Shipping does not itself transport, handle, or take physical possession of shipments and therefore is not liable for loss, damage, theft, delay, or failure of any shipment.
3. Carrier Liability Limits
Each carrier has its own liability limits for lost or damaged shipments. These limits vary and are typically expressed as a per-kilogram or per-pound value. Common standard liability limits include:
- Canada Post: subject to the standard terms of Canada Post Corporation.
- Canpar, Purolator, UPS, FedEx, DHL: per-shipment limits as published by each carrier.
- Freight/LTL carriers: per-kilogram limits as specified in carrier tariffs.
It is the User's responsibility to review the applicable carrier's terms and conditions prior to shipping.
4. Limitation of Eyemesto Shipping Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EYEMESTO SHIPPING SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, DELAY, MISDELIVERY, OR FAILURE TO DELIVER ANY SHIPMENT. THE USER ASSUMES FULL RESPONSIBILITY FOR OBTAINING ADEQUATE INSURANCE COVERAGE FOR THE VALUE OF SHIPPED GOODS.
5. Declared Value and Insurance
Users may declare a value for their shipment at the time of booking. Declaring a value may extend limited carrier liability up to the declared amount, subject to the carrier's terms. Eyemesto Shipping may offer optional shipment insurance through third-party insurance providers; such insurance is governed by the applicable Insurance Terms and Conditions.
6. Claims Process
In the event of loss, damage, or delay, Users must:
- Notify Eyemesto Shipping within 7 days of the scheduled delivery date for loss or non-delivery.
- Notify Eyemesto Shipping within 48 hours of delivery for visible damage.
- Retain all original packaging and damaged goods for carrier inspection.
- Submit a formal claim with supporting documentation (photos, receipts, packing slips) via the platform or by email to legal@eyemestoshipping.com.
All claims are subject to the carrier's investigation and resolution procedures. Eyemesto Shipping will facilitate claims but cannot guarantee outcomes determined by the carrier.
7. Exclusions from Coverage
Neither Eyemesto Shipping nor its carrier partners will accept liability for:
- Prohibited or improperly declared items.
- Inadequate packaging by the shipper.
- Acts of God, natural disasters, or force majeure events.
- Inherent defects in goods shipped.
- Delays caused by customs clearance.
- Indirect, consequential, or punitive damages.
